HIGHWAYS ACT 1980 DENBIGHSHIRE COUNTY COUNCIL (DYSERTH 9)
PUBLIC PATH DIVERSION ORDER 2019
Ar 14eg Ionawr2020, cadarnhaodd Cyngor Sir Ddinbych y Gorchymyn uchod a wnaed dan Adran 119 Deddf Priffyrdd 1980. Effaith y Gorchymyn fel i cadarnhawyd yw gwyro'r damau o Iwybrau troed a ddisgrifir yn 1) isod i linell wahanol a ddisgrifir yn 2) isod.
1) Disgrifiad o'r llwybr troed presennol.

Y rhan hwnnw o Lwybr Cyhoeddus 9 yng Nghymuned Dyserth yn Sir Ddinbych yn dechrau o bwynt A ar y map sydd wedi'i gynnwys yn y gorchymyn hwn ar Gyfeirnod Grid yr OS 05017 79719 ac yn mynd i gyfeiriad y de ddwyrain am oddeutu 232.9 metr i bwynt B ar y map ar Gyfeirnod Grid OS 05232 79630 a ddangosir gyda llinell frown ddi-dor rhwng pwyntiau A-B ar y map sydd wedi'i gynnwys yn y Gorchymyn.
2) Disgrifiad o'r llwybr newydd.

Bydd yn cael ei wyro i linell wahanol sy'n dechrau o bwynt A ar y map sydd wedi'i gynnwys yn y gorchymyn hwn ar Gyfeirnod Grid OS SJ 05017 79719 ac yn mynd i gyfeiriad y de ddwyrain am oddeutu 208 metr i bwynt D ar y map ar Gyfeirnod Grid yr OS SJ 05195 79618 fel y dangosir gan linell doredig werdd rhwng pwyntiau A-C-D ar y map sydd wedi'i gynnwys yn y Gorchymyn.
Mae copi o'r Gorchymyn, fel y"\ cadarnhawyd, a chynllun wedi'u gosod a gellir eu gweld am ddim, yn ystod oriau agor Llyfrgell Prestatyn, 21 Kings Avenue, Prestatyn, Sir Ddinbych LL19 9AA, ac yn ystod oriau rhesymol yn swyddfeydd yr unigolyn sydd wedi llofnodi isod.

Daw'r Gorchymyn i rym ar 24ain lonawr 2020, ond petai unigolyn yn dymuno cwestiynu ei ddilysrwydd, neu unrhyw ddarpariaeth sy'n rhan ohono, ar y sail nad yw'n cael ei gynnwys ym mhwerau Deddf Priffyrdd 1980 diwygiedig, neu ar y sail nad yw'n cydymffurfio ag unrhyw ofynion y Ddeddf, fel y'i diwygiwyd, neu unrhyw reoliad a wnaed o dan y Ddeddf mewn perthynas a'r Gorchymyn, gall ef neu hi, yn unol a pharagraff 2 Adran 2 y Ddeddf fel y cymhwysir gan baragraff 5 Adran 6 y Ddeddf, wneud cais i'r Uchel Lys o fewn chwe wythnos o 14eg lonawr 2020.

On 14th January 2020, Denbighshire County Council confirmed the above Order made under Section 119 of the Highways Act 1980. The effect of the Order as confirmed is to divert the lengths of footpaths described in 1) below to a different line described in 2) below.
1) Description of existing footpath.

That section of Public Footpath 9 in the Community of Dyserth in the County of Denbigh commencing at point A on the map contained in this order at OS Grid Reference SJ 05017 79719 and running in a south easterly direction for approximately 232.9 metres to point B on the map at OS Grid Reference SJ 05232 79630 as shown by a solid brown line between the points A-B on the map contained in the Order.
2) Description of new route.

Which shall be diverted to a different line commencing from point Aon the map contained in this order at OS Grid Reference SJ 05017 79719 and runs in a south easterly direction for approximately 208 metres to point D on the map at OS Grid Reference SJ 05195 79618 as shown in green dashes between the points marked A-C-D on the map contained in the Order.
A copy of the Order, as confirmed, and the plan have been placed and may be seen free of charge, during opening hours at Prestatyn Library, 21 Kings Avenue, Prestatyn LL19 9AA, and at all reasonable hours at the offices of the undersigned.
The Order comes into force on 24th January 2020, but if a person aggrieved by the Order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from 14th January 2020 make an application to the High Court.
