A MAN from Conwy has been awarded more than £13,000 after an employment tribunal ruled that he was unfairly dismissed by a Mochdre construction firm now in liquidation.

Jethro Faulkner won claims of both wrongful (breach of contract) and unfair dismissal against Ray Seager Scaffolding Services Ltd at a hearing on February 2.

Employment judge James Bromige found that Ray Seager Scaffolding Services had failed to provide Mr Faulkner with “written particulars of employment” and a written statement for his dismissal.

Ray Seager Scaffolding Services was also found to have failed to pay Mr Faulkner for one week prior to his dismissal, and to have failed to pay him statutory notice pay.

The tribunal awarded Mr Faulkner the following sums:

  • One week of unpaid wages - £109.40
  • Nine weeks of statutory notice pay (February 22 – April 29, 2023) - £4,140.00
  • Unfair dismissal - £4,140.00
  • Loss of earnings from April 30 – June 21, 2023 - £2,730.00
  • Loss of employer pension contributions for 17 weeks - £234.60
  • Loss of statutory rights - £500.00
  • Expenses incurred looking for new employment - £40.00
  • Failure to provide written particulars of employment - £1,840.00
  • Failure to provide written statement of reasons for dismissal - £920.00

This amounted to a total sum of £13,408.64.

Ray Seager Scaffolding Services was founded in 2000, but had liquidators appointed last September.

Based at Quinton Hazell Enterprise Parc, the company owed more than £400,000 to creditors, according to its last statement of affairs published on Companies House in October.
